The student who has forfeited his/her motor vehicle operator's license because of non-compliance with State Law 18-8-11 must attend school as stated below:
16 & 17 Year olds:
Upon enrolling as a new student at the Jackson County Adult Learning Center, the 16 & 17 year old student who has obtained a 9.0 to a 12.9+ grade assessment level in Reading and Mathematics on the TABE (Test of Adult Basic Education) test will be able to take the GED® Official Practice Test. For the 16 & 17 year old student who does not obtain a 9.0 or above on the TABE assessment, the student must attend a minimum of 12 hours per week, for a minimum of 30 hours. At that time, if the student is prepared sufficiently in the judgment of the ABE staff, a GED® Official Practice Test (OPT) will be administered. If the student fails to complete this requirement for any reason other than a medical reason documented in writing, the parent/guardian will be notified and the student will restart the 12 hours per week, for a minimum of 30 hours requirement before seeking the documentation required for initiating a learner's permit or operator's license.
If the student is not prepared for the GED® Official Practice Test (OPT) score of a 420 with a total of 2250 points, the student will continue to come to class for 12 hours per week and will have to wait 4 weeks before retesting and meeting the requirements set forth for the OPT.
"WV Department of Education Verification of Attendance/Enrollment Form-For Instruction Permit or License" is given to the student after the GED® Official Practice Test is passed with a 420 or higher (800 is the highest score) on each of the 5 subject areas of Science, Social Studies, Language Arts, Reading, Mathematics, and Language Arts, Writing and with a total score meeting or exceeding 2250. The 16 and 17 Year old student must continue to come to class for 12 hours per week until the next scheduled test.
If the student fails on maintaining the 12 hours per week after receiving the "WV Department of Education Verification of Attendance/Enrollment Form-For Instruction Permit or License" the Attendance Director will be notified to take the necessary action to have the student's privileges of operating a motor vehicle revoked and will have to restart the 12 hours, for a minimum of 30 h ours until the next scheduled test.
18 years old and older:
Upon enrolling as a new student at the Jackson County Adult Learning Center, the 18 year old and older student who has obtained a 9.0 to a 12.9+ grade assessment level in Reading and Mathematics on the TABE (Test of Adult Basic Education) test will be able to take the GED® Official Practice Test. This student WILL BE ENCOURAGED to come to Adult Basic Education classes until the next scheduled testing date.
The 18 year old and older student, who scores below 9.0 assessment level in the Reading and Mathematics on the TABE test, must attend a minimum of 30 hours, before taking the GED® Official Practice Test. These students are HIGHLY ENCOURAGED to come to Adult Basic Education class for a maximum of 12 hours per week.

As of January 1, 2010, the Jackson County Adult Learning Center will follow the stated rules below:
1.
For all GED candidates who DO NOT pass the initial OPT tests with a score of 420 for each subtest and a total of 2250 points, the candidate will:

Be required to obtain a minimum score of 420 on each of the 5 content area tests on the OPT.
·
Be required to wait 4 weeks prior to retaking the OPT tests.
·
Be required to complete at least 12 hours of preparation classes for the GED Test at an ABE center or via an approved ABE distance education program.
2.
For all candidates who DO NOT pass the GED Tests, the candidate will:

Be required to obtain a minimum score of 430 on content area tests and a total of 2250 points on the OPT.
·
Be required to pass the OPT using only forms PD, PE, PF, PG to determine eligibility for taking the TED tests (except in the case of the large print or Braille, which are only available in the PA).
3.
For all GED candidates who DO NOT attend the GED testing Session (a "NO-SHOW"), the candidate will:

Be required to complete 12 hours of preparation classes for the GED tests at an official ABE center or via an approved ABE distance education program.
·
Retake the OPT and score at least 430 on the content tests with a total of 2250 points overall.
·
The student may not take the next scheduled test. The examiner will post a note indicating when the student may test.
